By selecting Accept and accessing the Preview of The Surveying Academy, you agree to these Terms & Conditions.

1. Purpose of the Preview

The Surveying Academy provides practical training, guidance, methods, tips and examples intended to support employers in delivering structured training and development to early-career building surveyors.

The Preview is provided for educational and professional development purposes. It is designed to complement the workplace training, experience, supervision, review and feedback provided by your employer.

The Surveying Academy does not replace your employer's responsibility to train, supervise and develop you.

The courses are intended to help you understand common tasks, approaches and good working practices that may assist you in your day-to-day role.

2. Supervision, competence and professional work

The Surveying Academy is a learning resource. It is not an instruction or authority to undertake professional work independently.

Completing any course, module, quiz, assessment or certificate within the Preview does not demonstrate, confirm or certify that you are competent to undertake any particular professional activity without appropriate supervision.

Nothing contained within the Preview grants or implies authority to carry out live project work without the supervision, review, approval or involvement required by your employer.

You must always:

• work within your own level of competence;

• follow your employer's procedures, policies and instructions;

• seek appropriate supervision, review and senior guidance where required; and

• comply with applicable legislation, professional standards and regulatory requirements, including relevant requirements of RICS.

3. Educational guidance only

Course content provides general educational guidance based on building surveying practice.

Examples, methods and suggested approaches are provided to support learning. They are not project-specific professional advice, legal advice, contractual advice or a substitute for professional judgement.

The appropriate approach to a live matter may depend upon the particular circumstances, your employer's procedures, your appointment and authority, the relevant contract, current legislation, professional standards and advice from appropriately experienced colleagues or specialists.

You must not rely solely upon training within The Surveying Academy where a live professional decision requires employer approval, supervision, specialist advice or project-specific consideration.

4. Personal licence to access the Preview

Access to the Preview is granted to you personally for your own learning and professional development.

Access to the Preview is granted for 14 days from enrolment.

Your access is personal, individual, limited, revocable and non-transferable.

Access granted to one learner does not give another individual, colleague, team, employer or organisation the right to access or use the training.

You may not sell, transfer, assign, sublicense or otherwise make your access available to another person.

5. Account security and login sharing

Your account and login credentials are for your use only.

You must not share your username, password, access link or other login credentials with another person.

You must not permit another person to access the Preview through your account, including a colleague, manager or another employee of the same organisation.

You must take reasonable steps to keep your login credentials secure and notify The Surveying Academy if you believe your account has been accessed without permission.

6. Group viewing and organisational use

Individual Preview access does not permit group viewing, classroom delivery, internal presentations or use of the Preview as an employer's own training resource.

You must not display, stream, present or deliver course content to a group of learners, colleagues or employees.

An employer forwarding the Preview to a learner does not acquire any licence or right to reproduce, present, distribute or use The Surveying Academy content internally.

Each person wishing to access the Preview must obtain their own authorised learner access.

7. Intellectual property

All intellectual property rights in The Surveying Academy and the Preview, including course text, graphics, photographs, illustrations, video, audio, narration, quizzes, assessments, course structure, teaching materials, downloadable resources, designs, branding and other content, are owned by or licensed to Redstone Education Ltd.

Access to the Preview gives you permission to view and use the content only for your own personal learning and professional development in accordance with these terms.

Ownership of the content does not transfer to you.

Nothing in these terms grants you any right to commercially exploit, reproduce, distribute, adapt, republish or create derivative training materials from The Surveying Academy content.

8. Copying, downloading, recording and reproduction

Unless The Surveying Academy expressly provides a particular item for download, saving or sharing, you must not:

• copy or reproduce course content;

• download or save course content;

• print course content;

• photograph course content;

• take screenshots of course content;

• screen-record or video-record course content;

• audio-record course content;

• transcribe course content;

• extract course files or materials; or

• otherwise capture or retain copies of course content.

You must not copy substantial amounts of course wording, questions, answers or other material into your own documents or records.

You may make reasonable personal notes in your own words for your own learning and professional development.

These restrictions do not apply to certificates, checklists, reference materials or other resources that The Surveying Academy expressly makes available for download, saving or sharing.

Any such material may only be used for the purpose for which it is provided and remains subject to any restrictions stated alongside that material.

A completion certificate may be shared as evidence of your own completion, provided that it is not altered or used to misrepresent your qualifications, competence or professional status.

9. Sharing, publication and redistribution

You must not share, email, upload, publish, transmit, distribute or otherwise make protected course content available to another person.

In particular, you must not upload, reproduce or store course content within:

• another learning management system;

• an employer intranet;

• an employer knowledge base;

• a shared drive or document repository;

• a website;

• a social media platform;

• a file-sharing service;

• a shared training library; or

• any other third-party system or resource.

You must not reproduce The Surveying Academy materials within your employer's induction, graduate development, staff training, CPD or learning resources without prior written permission from Redstone Education Ltd.

10. Artificial intelligence and automated systems

You must not upload, submit or otherwise provide protected The Surveying Academy course content to artificial intelligence systems, large language models, machine-learning systems, automated transcription services or similar third-party tools.

This includes course text, screenshots, photographs, audio, video, transcripts, quiz content, course files or other training materials.

You must not provide such material to these systems for purposes including:

• summarisation;

• analysis;

• rewriting;

• transcription;

• indexing;

• reproduction;

• generation of other training content;

• model training; or

• any other purpose.

You must not use automated tools, bots, crawlers, scraping software or other technology to extract, collect, reproduce or systematically access content from the Preview.

11. Creating other training or competing materials

You must not reproduce, adapt, repackage or use substantial parts of The Surveying Academy content to create or assist in creating:

• internal training courses;

• commercial training products;

• learning resources;

• presentations;

• guidance documents;

• online courses;

• induction materials;

• assessments;

• question banks; or

• other educational or professional development materials.

You must not remove, obscure or alter The Surveying Academy branding, copyright notices or other proprietary notices.

Nothing in these terms prevents you from applying knowledge and skills genuinely learned through the Preview in your own day-to-day professional development and supervised work.

12. Technical protection and circumvention

You must not attempt to bypass, disable, interfere with or circumvent any access control, security measure or technical restriction applied to the Preview.

You must not attempt to obtain, extract or access underlying course files, source material, package contents, administration areas or other content that is not made available through the normal learner interface.

13. Monitoring and investigation of misuse

Redstone Education Ltd may use information generated through its learning platform to protect the security and integrity of The Surveying Academy and to investigate suspected misuse.

This may include available records relating to account and login activity, course access and activity, learner progress and completion, assessment activity, session information, unusual or simultaneous access patterns and other information reasonably required to investigate suspected misuse.

Any personal information used for these purposes will be processed in accordance with applicable data protection law and The Surveying Academy's Privacy Policy.

14. Suspension and termination

Redstone Education Ltd may suspend or terminate access where it reasonably believes that:

• these terms have been breached;

• an account is being shared;

• content is being copied, recorded or distributed;

• access is being misused;

• technical controls are being circumvented; or

• suspension is reasonably necessary to protect The Surveying Academy, its users, its systems or its intellectual property.

Serious or repeated infringement may result in permanent withdrawal of access.

Suspension or termination does not affect any rights or remedies that Redstone Education Ltd may have in relation to copyright infringement, misuse of intellectual property, breach of these terms or other unlawful conduct.

Where appropriate, Redstone Education Ltd may pursue remedies available to it by law.

15. Free access and availability

The Preview is currently provided without charge.

Free access does not create an entitlement to permanent or continuing access.

Redstone Education Ltd may update, replace, restrict, suspend or withdraw the Preview, or any part of it, including for content updates, maintenance, security, platform changes, suspected misuse or business reasons.

Reasonable steps will be taken to operate the learning service appropriately, but uninterrupted or error-free availability cannot be guaranteed.

16. Course content and updates

The Surveying Academy takes reasonable care in preparing its training materials.

However, legislation, professional standards, contracts, guidance, technology and accepted industry practice may change over time.

Course content may therefore be amended, replaced or withdrawn.

Learners must check current requirements and seek appropriate workplace, professional or specialist guidance where required rather than treating previously completed training as a permanent statement of current requirements.

17. Assessments and certificates

Quizzes, knowledge checks and assessments within The Surveying Academy are learning tools.

A passing score demonstrates only that the learner has satisfied the stated requirements of that particular learning activity.

A certificate issued for completion of the Preview confirms completion of the relevant training only.

It does not:

• certify professional competence;

• confirm that the learner is competent to work independently;

• constitute a professional qualification;

• authorise the learner to undertake any particular professional activity;

• confirm satisfaction of any RICS competency or assessment requirement; or

• replace employer assessment, supervision or professional judgement.

The Surveying Academy is not presented as being accredited, approved or endorsed by RICS unless expressly stated otherwise.

18. Responsibility for professional work

Responsibility for determining what live work a learner may undertake, the level of supervision required, whether work requires review or approval, and whether the learner is competent to undertake a particular task remains with the learner and their employer in accordance with applicable professional obligations.

Redstone Education Ltd does not control or determine an employer's allocation, supervision, review or approval of live professional work.

A learner must not use completion of The Surveying Academy training as justification for acting outside their competence or without appropriate supervision, review or employer approval.

19. Data protection

Personal information associated with registration, access, learner activity, evaluation, communication and certification will be processed in accordance with applicable data protection law and The Surveying Academy's Privacy Policy.

20. Liability

Nothing in these terms excludes or limits any liability where it would be unlawful to do so.

Nothing in these terms excludes or limits liability for:

• death or personal injury caused by negligence where liability cannot lawfully be excluded;

• fraud or fraudulent misrepresentation; or

• any other liability that cannot lawfully be excluded or limited.

To the extent permitted by law, Redstone Education Ltd is not responsible for loss arising because a learner:

• uses educational content as a substitute for required professional supervision;

• undertakes work outside their competence;

• disregards employer procedures, instructions, review or approval requirements;

• relies upon general educational examples as though they were project-specific professional, legal or contractual advice; or

• continues to rely upon training content where relevant law, standards, guidance or circumstances have changed.

The Preview is provided as educational support and does not replace the professional decisions that must be made by appropriately competent, authorised and supervised individuals in relation to live professional work.

Nothing in these terms affects any mandatory statutory rights that cannot lawfully be excluded or limited.

21. Changes to these terms

Redstone Education Ltd may update these terms where reasonably necessary, including to reflect changes to the Preview, The Surveying Academy, applicable law or regulation, professional requirements, technology, security requirements or business practices.

Where a material change affects continuing learner access, learners may be required to accept updated terms before continuing to use the Preview.

22. Severability

If any provision of these terms is found to be invalid, unlawful or unenforceable, that provision will be treated as modified to the minimum extent necessary to make it valid and enforceable where possible.

If that is not possible, the affected provision will be treated as removed.

The remaining provisions will continue in effect.

23. No waiver

If Redstone Education Ltd does not immediately enforce a right or provision under these terms, this does not mean that it has waived that right or provision.

Any waiver must be expressly given and will apply only to the particular circumstances for which it is given.

24. Third-party rights

Unless expressly stated otherwise, a person who is not a party to these terms has no right to enforce any provision of them.

25. Governing law

These terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction, subject to any mandatory rights or jurisdictional rules that apply by law.
